What This Service Includes

This flat-fee service covers a single, complete mediation process arising out of a dispute involving California Association of Realtors forms. The engagement begins with a one-hour strategy session to develop the client’s case, followed by in-depth legal review and analysis of the relevant contracts, disclosures, correspondence, and key facts.

We prepare and serve the demand for mediation, handle mediator negotiation and selection with opposing counsel or the other party, and coordinate and schedule the mediation session. We prepare a comprehensive, advocated mediation brief designed to clearly present your position and your objectives. We attend the mediation session with you, handle negotiation during the session, and, if a resolution is reached, prepare or review and revise the settlement agreement during or immediately following the mediation.

This package is suitable for both buyers and sellers and is designed to take a dispute from intake through a single mediation session with a clear, professional, and goal-oriented process.

How It Works

After you engage us, we begin with a strategy session to understand your goals and develop your case theory. We then conduct a detailed legal and factual review and prepare the demand for mediation. We handle mediator selection discussions and scheduling. Before the session, we prepare and submit a comprehensive mediation brief. We attend the mediation with you and conduct negotiations during the session. If a settlement is reached, we prepare or review and revise the settlement agreement at that time or immediately after the session.

This package is limited to one full day mediation session or two half-day sessions not to exceed 10 hours in either case.

What This Service Does Not Include

This service does not include mediator fees, expert fees, court filing fees, discovery, motion practice, trial preparation, or litigation. It does not include multiple mediation sessions, arbitration, or court proceedings. It also does not include any services after the mediation session(s), including enforcement, litigation, or further negotiations, unless covered by a separate written agreement.

If the matter does not resolve at mediation or requires additional work beyond the session(s) covered by this package, any further services would require a new engagement.
