What This Service Includes
This flat-fee service provides full legal structuring and documentation of seller carryback financing for California real estate transactions. We work with the parties to confirm the financing terms and prepare the core loan and security documents, including the promissory note, deed of trust, required disclosures, and the appropriate seller financing addenda to the purchase agreement. We also coordinate these documents with escrow to ensure they are properly signed, recorded, and integrated into the closing process. All financing documents and addenda are reviewed by an attorney before they are finalized, and the loan structure is aligned with the overall transaction and closing timeline.
This service may be purchased as an add-on to our Attorney-Managed Private Sale Transaction Package or as a standalone service for transactions that are already in escrow.
How It Works
After you engage us, we will gather the key financing terms, review the structure of the transaction, and prepare the required loan, security, and contract addendum documents. We will coordinate directly with escrow and title to ensure the documents are executed and recorded correctly and incorporated into closing. Throughout the process, the seller financing is handled with attorney oversight to ensure the documents are consistent, enforceable, and properly integrated into the transaction.
What This Service Does Not Include
This service does not include loan servicing, payment collection, enforcement, foreclosure, or representation in the event of a default. It is intended for standard, single-property seller financing structures. More complex or non-standard arrangements, including multi-property collateral, cross-collateralization, or unusual security or repayment structures, may require a separate engagement or adjusted pricing by agreement.
