Lease-to-own and lease option transactions combine leasing and purchase concepts, and they are often misunderstood or poorly documented. If the structure is unclear, disputes commonly arise over option payments, credits, timing, responsibility for repairs, disclosures, and what happens if the option is or is not exercised. This package provides a professionally structured agreement set, a seller disclosure packet, and a property due diligence and risk snapshot so the transaction is documented and approached with eyes open.
We prepare the core agreement set based on the agreed business terms, provide the seller disclosure forms and advisories, produce a permit history report, and prepare a due diligence and risk snapshot. The package includes a consultation to review the structure, explain the key provisions, and answer questions before the documents are finalized.
What This Service Includes
This flat-fee service includes preparation of a lease-to-own or lease option agreement set tailored to your transaction. The documents typically address the lease terms, the option or purchase rights, any option payment or credits, the purchase price or pricing method, the option period, responsibility for maintenance and expenses, and the process for exercising the option and transitioning into a sale.
This package also includes our Residential Seller Disclosure Packet. We provide the standard disclosure form set, applicable local disclosures, written advisories addressing common disclosure issues, and a permit history report. The seller completes the disclosure forms based on their own knowledge of the property. We then review the completed disclosures with the seller and discuss questions, concerns, and areas that may benefit from clarification before the disclosures are delivered.
In addition, this package includes our Property Due Diligence and Risk Snapshot. We compile and organize key desktop due diligence materials, such as permit history, parcel and assessor information, flood map context, MLS listing history where available, and a property-specific comparative market analysis, and we provide a short written summary highlighting key findings and potential follow-up items.
The service includes a consultation to review the structure and documents, explain the key provisions in plain English, and answer questions so you understand how the transaction is intended to work and what the main risk considerations are.
How It Works
After you engage us, you will complete a guided intake and provide the basic deal terms and property information. We will prepare the lease-to-own or lease option agreement set, provide the seller disclosure forms and advisories, obtain and prepare the permit history report, and compile the due diligence and risk snapshot materials with a written summary. We will then schedule a consultation to review the structure, walk through the documents and findings, and answer questions. After that review, we will finalize the documents and deliver the full packet to you for use in your transaction.
What This Service Does Not Include
This service does not include negotiating with the other party, communicating with lenders, title companies, or escrow, managing a closing, or providing ongoing advice beyond the included consultation. It does not include physical inspections, surveys, engineering or environmental review, appraisals, zoning or entitlement analysis, title curative work, or full transaction management. It also does not include preparing the factual content of the seller’s disclosures, which remain the seller’s responsibility. If the transaction requires contested negotiations, complex financing structures, or ongoing deal management, a separate engagement may be required.
